FIBERFI Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the internet services and related network, equipment, and facilities (collectively, the "Services") provided by FIBERFI and its affiliates (collectively, "FIBERFI", "us", "we", or "our"). By activating, using, or paying for the Services, you agree to be bound by these Terms. These Terms incorporate by reference our Acceptable Use Policy, Privacy Policy, and Network Management Policy. We may modify these Terms as described in Section 7 (Changes to These Terms). If you do not agree to be bound by these Terms, you must immediately stop using the Services.
1. The Services
FIBERFI provides broadband internet access and related services to residential, business, multi-family, and wholesale customers. We may also offer supplementary services such as cloud computing platforms, hosted applications, email, and other network-based offerings (collectively with internet access, the "Services"). Service availability, speeds, pricing, and equipment offerings vary by location and plan. Plan details, pricing, and performance characteristics are described on our website and in the FIBERFI Network Management Policy. Your use of the Services is also subject to our Acceptable Use Policy.
2. Account and Payment
- You are responsible for maintaining the accuracy of your account information and for all activity that occurs under your account.
- Service charges are due on the dates stated on your invoice. Late or unpaid balances may result in suspension or termination of the Services.
- If payment is made by credit card, debit card, or bank account, you authorize FIBERFI (and its billing processors) to charge that payment method for all amounts due.
- Equipment provided by FIBERFI remains our property (unless expressly stated otherwise) and must be returned in good condition upon disconnection of the Services.
3. Data Loss, Backups, and Hosted Services
FIBERFI provides internet access and, in some cases, supplementary hosted offerings such as cloud computing platforms, hosted storage, email, and other network-based services (collectively, "Hosted Services"). While these Hosted Services may involve the storage and processing of your data, FIBERFI is not a backup provider, and you remain solely responsible for protecting your data. Specifically:
- Your responsibility: You are solely responsible for backing up, and maintaining independent copies of, all data, files, configurations, and content that you store on, transmit through, or make accessible using the Services or any Hosted Services, including any data stored on equipment we provide to you.
- Hosted Services are not backups: Any storage, replication, or redundancy provided as part of a Hosted Service (including cloud computing platforms) is intended for service availability and operation, not as a backup or archive of your data. Such features do not relieve you of your obligation to maintain your own backups.
- No backup warranty: FIBERFI does not warrant that any data transmitted, stored, or processed through the Services or any Hosted Service will be preserved, recovered, or protected against loss, corruption, or destruction.
- No liability for data loss: To the maximum extent permitted by law, FIBERFI shall not be liable for any loss, corruption, or destruction of your data or content, regardless of cause — including equipment or storage failure, power events, software errors, cyberattacks, natural disasters, outages, network maintenance, suspension, or termination of the Services or any Hosted Service.
- Deletion upon termination: When your Services are terminated or disconnected, any data associated with your account — including data stored on returned or reassigned equipment and data stored within any Hosted Service or cloud computing platform — may be deleted without notice. It is your responsibility to retrieve your data before disconnection.
4. Service Availability and Interruptions
The Services are provided on an "as is" and "as available" basis. While we design our network for reliability, we do not guarantee uninterrupted or error-free service. The Services may be interrupted, degraded, modified, or suspended for maintenance, upgrades, force majeure events, network or national security emergencies, or other operational reasons. Planned and unplanned interruptions may occur with or without notice. You should not rely on the Services as your only means of communication or as critical infrastructure for life-safety, medical, or emergency purposes.
5. Limitation of Liability
To the maximum extent permitted by applicable law:
- FIBERFI shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of business, arising out of or relating to the Services or these Terms, even if advised of the possibility of such damages.
- FIBERFI's total aggregate liability arising out of or relating to the Services shall not exceed the fees you paid to FIBERFI for the Services in the twelve (12) months preceding the event giving rise to the claim.
- Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or violations of statutory consumer protections.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.
6. Suspension and Termination
FIBERFI may suspend or terminate the Services, with or without notice, if you violate these Terms or the Acceptable Use Policy, fail to pay amounts due, or if necessary to protect the network, other customers, or the public. You may cancel the Services at any time in accordance with the terms of your service agreement; applicable charges, deposits, and equipment return requirements apply. Upon termination, your right to use the Services ends immediately, and Sections 3, 5, and 7 survive.
7. Changes to These Terms
We may update these Terms to reflect changes in our practices, technology, or legal requirements. Non-material updates are effective upon publication to this website. For material changes, we will notify you via email, our website, or your billing statement in advance of the change taking effect, and such material changes will not take effect until that notice period has passed. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
