Acceptable Use Policy

This Acceptable Use Policy (the "Policy") sets forth the acceptable use of and access to FIBERFI and its affiliates (collectively, "FIBERFI", "us", "we", or "our") internet services and related network, equipment and facilities (collectively, the "Services") by you. We may modify this Policy at any time and any such modification will be effective upon its publication. You are solely responsible for monitoring this website for such modifications. If you do not agree to be bound by this Policy, then you must immediately stop using the Services.

1. Prohibited Activities

All Services provided by FIBERFI to you may only be used by you for lawful purposes. The transmission, distribution, or storage of any data in violation of any law is prohibited, including, without limitation: (i) data protected by copyright, trademark, trade secret, or other intellectual property right; (ii) data that is obscene, defamatory, or constitutes an illegal threat; (iii) violations of export control laws; (iv) unlawful or inappropriate interactions with minors; (v) child pornography; and (vi) any activity that FIBERFI determines to interfere with or be harmful to any user, operation, reputation, goodwill, or customer relations. In situations where material is carried across networks of other internet service providers, your use of the Services must also conform to the applicable acceptable use policies of such other service providers.

Additionally, violation of the CAN-SPAM Act of 2003, or any other applicable law regulating email services, constitutes a violation of this Policy. Sending unsolicited email messages, including without limitation, commercial advertising, informational announcements, instant messenger programs, and usenet that promotes or advertises a service, product, cause, opinion, money-making opportunity, or similar opportunity that a recipient did not specifically request from the sender is explicitly prohibited.

2. Telephone Consumer Protection Act and Robocall Compliance

You will comply with all applicable federal, state, and local laws and regulations governing voice, text messaging, and communications activities when using the Services, including the Telephone Consumer Protection Act, 47 U.S.C. § 227 ("Restrictions on use of telephone equipment"), and FCC implementing rules, 47 C.F.R. Part 64 (collectively, the "TCPA"). The Services will not be used for generating misleading caller identification information, employing caller ID spoofing techniques, changing identification headers or addressing data, or taking any steps to conceal or misstate the true source or identity of a communication. You agree to comply with TCPA regulations and laws required for the use of automatic telephone dialing systems, prerecorded voices, artificial intelligence (AI) voices, or SMS/MMS messaging. Additionally, you will accurately identify the caller or sender; provide clear and conspicuous opt-out methods; maintain required TCPA consents; comply with do-not-call requests; comply with federal and state do-not-call requirements; maintain internal do-not-call lists; and use the National Do Not Call Registry, as required by law.

3. Security Violations

You are solely responsible for ensuring and maintaining the security of your network that connects to and uses the Services, including implementation of all patches and operating system updates.

The Services may not be used to interfere with, gain unauthorized access to, or otherwise violate the security of FIBERFI's (or another party's) server, network, network access, personal computer or control devices, software or data, or other system, or to attempt to do any of the foregoing. Examples of such security violations include, but are not limited to:

  • unauthorized monitoring, scanning or probing of a network or any other action aimed at the unauthorized interception of data or harvesting of email addresses;
  • hacking, attacking, gaining access to, breaching, circumventing or testing the vulnerability of the user authentication or security of any host, network, server, personal computer, network access and control devices, software or data without express authorization of the owner of the network;
  • impersonating others or secretly or deceptively obtaining personal information of third parties (phishing, etc.);
  • using any program, file, script, command or transmission of any message or content of any kind, designed to interfere with a terminal session, the access to or use of the Internet, or any other means of communication;
  • distributing or using tools designed to compromise security (including but not limited to SNMP tools), including cracking tools, password guessing programs, packet sniffers or network probing tools (except in the case of authorized legitimate network security operations);
  • knowingly uploading or distributing files that contain viruses, spyware, Trojan horses, worms, time bombs, cancel bots, corrupted files, root kits or any other similar software or programs that may damage the operation of another's computer, network or other property, or be used to engage in modem or system hijacking;
  • engaging in the transmission of pirated software;
  • using manual or automated means to avoid any use limitations placed on the Services;
  • providing guidance, information or assistance with respect to causing damage or a security breach to FIBERFI's network or to the network of any other internet service provider;
  • use of bandwidth in a manner that degrades or interferes with other customers' use of the network, or that exceeds any specific limit allocated to your plan as described in the FIBERFI Network Management Policy;
  • use of the Service in Cuba, Iran, North Korea, Sudan and Syria or to destinations that are otherwise controlled or embargoed under U.S. law; and
  • failure to take reasonable security precautions to help prevent violation(s) of this Policy.

4. Your Responsibilities

You remain solely responsible for the content of any material posted, hosted, downloaded, uploaded, created, accessed, distributed, or transmitted using the Services. FIBERFI has no responsibility for any material created on FIBERFI's network or accessible using the Services, including content provided on third-party websites linked to the FIBERFI network. Such third-party website links are provided as internet navigation tools for informational purposes only, and do not constitute in any way an endorsement by FIBERFI of the content(s) of such sites. FIBERFI is only the provider of the Services and will not be liable for any statements, representations, or content provided by or encountered by you. You are responsible for taking prompt corrective action(s) to remedy a violation of this Policy and to help prevent similar future violations.

5. Liability Disclaimer

Your access to and use of the Services is solely at your own risk and is subject to all applicable local, state, national, and international laws and regulations. Access to the Internet may be dependent upon numerous factors, technologies, and systems, many of which are beyond our authority and control. We make no warranties, express or implied, including but not limited to those of merchantability or fitness for a particular purpose. This includes but is not limited to the loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions regardless of cause.

FIBERFI does not monitor, verify, warrant, or guarantee the accuracy of the information that users may acquire over the internet, and does not monitor the content of your communications. You must exercise your best judgment in relying on information obtained from the internet. Since FIBERFI does not monitor internet content, FIBERFI cannot accept any responsibility for any injury to users that results from inaccurate, unsuitable, offensive, or illegal internet communications. Further, FIBERFI does not review, edit, censor, or take responsibility for any information you may create on the internet. Notwithstanding the foregoing, FIBERFI may monitor network performance and traffic in aggregate to determine that its network and facilities are operating satisfactorily, if required to do so by law or government authority, or when public safety is at stake.

FIBERFI takes no responsibility and assumes no liability for any content uploaded, transmitted, or downloaded by a user or any third party, or for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity that a user may encounter.

6. Indemnity

You will indemnify, defend, release, and hold harmless FIBERFI and its parents, affiliates, partners, directors, officers, employees, representatives, agents, successors, and assigns from and against all liabilities, obligations, proceedings, actions, suits, claims, damages, costs, fines, penalties, expenses and fees (including reasonable legal fees and costs) arising out of or related to: (i) your access to or use or unauthorized use of the Services; (ii) your violation of this Policy; and (iii) the rights of any third party.

7. Enforcement

Your failure to observe the guidelines set forth in this Policy may result in FIBERFI taking actions which may vary from a warning to a suspension or termination of your Services. When feasible, FIBERFI may, but is not obligated to, provide the customer with a notice of an AUP violation and may allow the customer to promptly correct such violation.

FIBERFI reserves the right, however, to investigate and act immediately and without notice to suspend or terminate affected Services in response to a court order or government notice that certain conduct must be stopped, or when FIBERFI reasonably determines that the conduct may: (i) expose FIBERFI to sanctions, prosecution, civil action or any other liability; (ii) cause harm to or interfere with the integrity or normal operations of FIBERFI's network; (iii) interfere with another FIBERFI customer's use of Services or the internet; (iv) violate any applicable law, rule or regulation; or (v) otherwise present an imminent risk of harm to FIBERFI or FIBERFI's customers.

Further, FIBERFI will cooperate with appropriate law enforcement agencies in investigating claims of illegal or inappropriate activity. FIBERFI may disclose information, including but not limited to information concerning a user or a transmission made using the Services, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation, or governmental request. FIBERFI assumes no obligation to inform you of any specific information that has been provided to any person or entity. FIBERFI may disclose user information or information transmitted over the Services where necessary to protect FIBERFI and others from harm, or where such disclosure is necessary to the proper operation of the system. In instances involving child pornography, FIBERFI complies with all applicable federal and state laws including providing notice to the National Center for Missing and Exploited Children or other designated agencies.
