Terms of Service

Effective Date: May 28, 2026 Welcome to FIBERFI (“FIBERFI,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our internet access services, related communications services, websites, customer portals, and associated equipment and infrastructure (collectively, the “Services”). By subscribing to or using the Services, you (“Customer,” “you,” or “your”) agree to these Terms.

1. Services Provided

FIBERFI provides broadband internet access services through fiber optic, fixed wireless, Ethernet, coaxial, and related networking technologies to residential, multi-dwelling unit (“MDU”), and commercial customers. Service availability, speeds, latency, and uptime may vary depending on location, building infrastructure, wireless conditions, upstream providers, network congestion, maintenance activities, and other factors. FIBERFI does not guarantee uninterrupted or error-free service.


2. Acceptable Use Policy

Customers agree to use the Services lawfully and responsibly. Prohibited activities include, but are not limited to:

  • Violating any local, state, or federal law
  • Distributing malware, viruses, or malicious software
  • Attempting unauthorized access to networks or systems
  • Excessive network abuse or denial-of-service activity
  • Sending spam or unsolicited bulk communications
  • Copyright infringement or illegal file sharing
  • Operating services that interfere with network stability
  • Reselling services without written authorization

FIBERFI reserves the right to suspend or terminate Services for violations of this policy.


3. Billing and Payments

Customers agree to pay all applicable fees associated with the Services.

Invoices are generally billed monthly and are due upon receipt unless otherwise agreed in writing.

Late payments may result in:

  • Service suspension
  • Late fees
  • Collection activity
  • Account termination

FIBERFI reserves the right to change pricing upon reasonable notice where permitted by applicable law.


4. Installation and Customer Equipment

Customers are responsible for maintaining compatible devices and internal wiring unless otherwise agreed in writing.

FIBERFI-owned equipment provided to the Customer remains the property of FIBERFI unless purchased outright.

Customers agree to return leased or loaned equipment upon termination of service. Failure to return equipment may result in replacement charges.

Customers shall not tamper with, relocate, or modify FIBERFI infrastructure or equipment without authorization.


5. Network Management

FIBERFI may implement reasonable network management practices to:

  • Maintain network stability
  • Prevent abuse
  • Reduce congestion
  • Protect customers and infrastructure
  • Enforce security policies

These practices may include traffic prioritization, bandwidth management, rate limiting, filtering of malicious traffic, or temporary service restrictions during abuse or network emergencies.


6. Service Interruptions and Maintenance

Service may occasionally be interrupted due to:

  • Scheduled maintenance
  • Power outages
  • Fiber cuts
  • Weather conditions
  • Third-party carrier failures
  • Equipment failures
  • Emergency repairs

FIBERFI is not liable for damages resulting from service interruptions, downtime, data loss, or performance degradation.


7. Limitation of Liability

To the maximum extent permitted by law, FIBERFI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, or service interruptions.

FIBERFI’s total liability arising out of or relating to the Services shall not exceed the amount paid by the Customer for Services during the thirty (30) days preceding the event giving rise to the claim.


8. Indemnification

Customers agree to indemnify and hold harmless FIBERFI, its owners, employees, contractors, affiliates, and partners from claims, damages, liabilities, costs, or expenses arising from:

  • Customer misuse of the Services
  • Violation of these Terms
  • Illegal or unauthorized activity
  • Infringement of third-party rights

9. Privacy

Use of the Services is also governed by the FIBERFI Privacy Policy available at:

10. SMS Communications

By checking the SMS consent box on a FIBERFI form, including our activation form at https://connect.fiberfi.net/instant, you consent to receive SMS text messages related to:

  • Account notifications
  • Billing notices
  • Appointment scheduling
  • Service updates
  • Customer support communications

Message frequency may vary depending on your scheduled installation, service appointment, account activity, or support request.

Message and data rates may apply.

You may opt out at any time by replying STOP to any message. For assistance, reply HELP or contact info@fiberfi.net.

Consent to receive SMS messages is optional and is not required to make a purchase or use FIBERFI services.


11. Copyright and DMCA Policy

FIBERFI respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (“DMCA”).

Customers may not use the Services to infringe copyrights or distribute copyrighted content unlawfully.

FIBERFI reserves the right to suspend repeat infringers.


12. Termination of Service

FIBERFI may suspend or terminate Services at any time for:

  • Nonpayment
  • Violation of these Terms
  • Fraudulent activity
  • Network abuse
  • Illegal conduct
  • Safety or infrastructure concerns

Customers may terminate Services subject to any applicable service agreements or notice requirements.


13. Changes to Terms

FIBERFI may update these Terms periodically. Updated versions will be posted on our website with a revised effective date.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.


14. Governing Law

These Terms shall be governed by the laws of the State of Oregon, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Oregon.
